These Terms of Service govern access to CareNest, including the public website, caregiver workspace, subscription pages, reminder workflows, and related communications.

Emergency Notice

CareNest is NOT an emergency service. It does not replace doctors, nurses, hospitals, 911, or emergency responders.

If there is a medical emergency or immediate safety concern, call 911 immediately.

1. Acceptance of Terms

By visiting the public website, creating an account, starting a trial, or using any feature of CareNest, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. Description of CareNest

CareNest helps families and caregivers manage medication reminder calls, follow-up records, caregiver alerts, and related care coordination workflows for older adults. CareNest is a support and organization platform only.

3. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use CareNest. By using the service, you represent that you meet this requirement.

4. User Accounts

You may need an account to access caregiver features. You agree to provide accurate, current, and complete information and to keep your account details updated, including contact information and time zone settings.

5. Account Security

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly if you believe your account has been accessed without authorization.

6. Subscription Plans

Paid plans, trial access, usage limits, and plan features are described on the pricing pages or inside the caregiver workspace. Plan details may vary by offering and may include limits on caregivers, elders, calls, or related usage.

7. Payments

If paid subscriptions are offered, you agree to pay all fees associated with the selected plan. Fees are listed in U.S. dollars unless otherwise displayed. Taxes, bank fees, and processor charges may apply where required by law or a payment provider.

8. Renewals

Recurring subscriptions may renew automatically for the same billing period unless canceled before the renewal date. Renewal timing, billing notices, and account status are governed by the subscription terms shown in your workspace.

9. Cancellation

You may cancel a subscription before the next renewal cycle. Cancellation stops future renewal charges but does not automatically erase prior account records, call history, or invoices that must be retained for operational, legal, or audit purposes.

10. Fair Usage Policy

You may not use CareNest in a way that overloads the service, interferes with other users, bypasses plan limits, scrapes data, reverse engineers workflows, or uses the platform for spam, abuse, or unlawful conduct.

11. AI Limitations

Some summaries, memories, call notes, or suggested insights may be generated with AI. AI output can be incomplete, inaccurate, or context-limited. You must review important information before relying on it for caregiving decisions.

12. Emergency Disclaimer

CareNest does not provide medical advice, diagnosis, treatment, monitoring, dispatch, or emergency response. The service may help with reminders and follow-up only. In any emergency, call 911 immediately and contact the appropriate licensed medical professionals.

13. User Responsibilities

You are responsible for entering correct elder details, medication schedules, caregiver contacts, and any other information submitted to the service. You are also responsible for obtaining any permissions or consents required to share elder information and receive reminder calls or notifications.

14. Intellectual Property

CareNest, its design, software, branding, content, workflows, and related materials are owned by us or our licensors and are protected by intellectual property laws. Except for limited access needed to use the service, no rights are transferred to you.

15. Privacy

Our handling of personal information is described in the Privacy Policy. By using CareNest, you acknowledge that information may be processed as described there.

16. Service Availability

We aim to keep the service available, but we do not guarantee uninterrupted access. Maintenance, outages, provider issues, carrier delays, AI limitations, and third-party incidents may affect reminders, calls, notifications, or dashboards.

17. Limitation of Liability

To the fullest extent permitted by law, CareNest and its operators, affiliates, employees, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, revenue, goodwill, or business opportunity arising from or related to the service.

18. Termination

We may suspend or terminate access if you violate these Terms, misuse the service, create risk to the platform or other users, or if continued access is not operationally feasible. You may stop using the service at any time.

19. Changes to Terms

We may update these Terms of Service from time to time. Updated terms become effective when posted on this page. Continued use after an update means you accept the revised terms.
